Timothy Chan graduated from the University of Birmingham, United Kingdom, with a Bachelor of Laws (Honours) in 2019. Thereafter, Timothy embarked on and completed his Relevant Legal Training and Practice Training Contract with the firm and was admitted as an Advocate and Solicitor of the Supreme Court of Singapore in 2021.
Since then, Timothy has had the opportunity to appear in front of Judges of the Supreme Court and State Courts. Some of the reported cases involving him are:-
- Assisting the Court to navigate the new law relating to insolvency and obtaining an order to under Section 264(4) of the Insolvency, Restructuring and Dissolution Act 2018 in Teunis Eigenraam v Ngng Pte Ltd [2023] 3 SLR 310. Timothy eventually succeeded in winding up the Company and appointing the liquidator of choice;
- Assisting in the defence of a lawyer in Disciplinary Proceedings and the subsequent success in preventing the striking out of the lawyer as sought by the Law Society of Singapore in the Court of 3 Judges in the cases of The Law Society of Singapore v Mohammed Lutfi Bin Hussin [2021] SGDT 6 and Law Society of Singapore v Mohammed Lutfi bin Hussin [2023] 3 SLR 509; and
- Assisting in an application on an application before trial dealing with an legal issue whether the plaintiffs in the case could claim two forms of damages. Before the General Division of the High Court, the plaintiffs succeeded in Amber Compounding Pharmacy Pte Ltd and another v Lim Suk Ling Priscilla and others [2023] SGHC 241. However, the team did not give up and took the matter on appeal, which was filed in the Appellate Division of the High Court but transferred to the Court of Appeal (the highest Court in Singapore). It was there that we succeeded although the Court of Appeal stated that fuller grounds of their decision would be published in due course.
Other noteworthy matters Timothy has worked on include:-
- Assisted a sub-contractor to obtain payment from the main contractor after the works were completed and payment was not received;
- Successfully defended a developer against claims from MCSTs for alleged defects in the condominiums developed;
- Assisted clients to file Trade Marks in the Singapore Trade Mark Registry and to search Registered Design Registries in Singapore and other jurisdictions;
- Obtained the Court’s sanction to sell Properties owned by an estate after more than 30 years of the deceased’s passing and where 3 of the 4 administrators had also passed away and subsequently assisted in the conveyancing of the sales of the Properties;
- Assisted a contractor in sorting out the disputes the contractor had with the developer and sub-contractors of projects that he was working, including claims of delays, whether the payment terms were met, and the assessment of the works done by the contractor;
- Successfully defended the executors of a Will (who were beneficiaries as well) in a claim made by the other beneficiaries of the Will against them for the decisions they made as executors in the distribution of the estate;
- Achieved a settlement between Australian companies and their Singapore investor when the investor tried to pull out his investment in the companies;
- Obtained Deputyship Orders to allow a nephew in Italy to manage the wellbeing and assets of his aunts in Singapore who had sadly became unsound;
- Assisted MCSTs in claims against Subsidiary Proprietors in both the Strata Title Board and the State Courts relating to claims for breach of by-laws and failure to pay the MCSTs;
- Successfully defended an accused in a Criminal matter where the Prosecution was seeking a jail term, the Court instead sentenced the accused to a fine (after the accused pleaded guilty);
- Assisting clients in their sale and purchase of shares of companies, investment deals, and other shareholder related transactions;
- Assisted claimant(s) in their application for a Personal Protection Order; and
- Assisting many buyers, sellers, transferors, and transferees in their conveyancing.
In particular, Timothy has keen interests in Intellectual Property dispute resolution and Medical Negligence.
Outside of his pursuit of the Law, Timothy actively pursues many hobbies and interests, including but not limited to, riding motorcycles (currently on a Yamaha R15 V3), building computers, programming, skydiving, specialty coffee, and performing magic.
